Opinion: New York Betting Too Much on Gambling

The current issue of New York magazine speaks of Governor Andrew Cuomo seeking “gambling everywhere.” That’s a bit of an exaggeration. In his recent State of the State speech, Mr. Cuomo called for a change in the state constitution to allow for non-Indian, off-reservation casinos in New York, which currently prohibits them. It’s not “gambling everywhere” but the governor does want a major expansion of legalized gambling.

“Cuomo Bets On A Casino” was the headline in Newsday. It referred specifically to Aqueduct Racetrack in Queens as a place where the governor wants to see a big casino.

A casino there would be a problem for the Shinnecock Indian Nation, which wants to build a casino at nearby Belmont Park in Elmont. Newsday quoted State Senator Jack Martins of Mineola as saying a casino at Aqueduct would “effectively kill” plans for a Shinnecock casino at Belmont. A broader concern is whether or not the legalized gambling market is being saturated by casinos opening all over the nation, -Native American and non-Indian.

Mr. Cuomo is betting on a big financial boost for New York State through a major expansion of legalized gambling here but the market has its limits.

The day of Mr. Cuomo’s State of the State speech, the New York Times reported on the “hopes of reviving Atlantic City.” Gambling revenue was down in Atlantic City, the Times reported, and there’s hope that a new $2.4 billion resort and casino, being built with state financial help, will “usher in a new era for Atlantic City.”

“Atlantic City has been in decline since 2006,” the Times reported, “when Pennsylvania opened its first casino, beginning a slow bleed of gamblers that have never returned. With rival casinos opening in Connecticut, Delaware, Maryland and upstate New York, there is little Atlantic City can do to stop the loss …”

This spread of gambling has not only hurt Atlantic City but Las Vegas, too, and severely. Factor in the impact of the recession on gambling and it would seem the industry is in trouble. So how can New York State figure on a big win?

But that’s the dream -or illusion-, not only in New York but other areas of the nation. A Times story last month reported on the Florida Legislature considering three “Las Vegas-style casino resorts” in south Florida to offset the economic downturn following the burst of Florida’s big real estate bubble.

Meanwhile, what about gambling as a way for Indian tribes to break out of centuries of economic hard times? That was the basis of the Indian Gaming Regulatory Act of 1988, the federal law that set up a system under which Native Americans were given the go-ahead -and structure- to develop gambling.
It was a kind of long-delayed reparation for Native Americans for the loss of their homeland and culture and it has made some tribes-, including several in Connecticut-, super-wealthy.

These days, if you take a drive on the stretch of New Mexico between Albuquerque and Santa Fe, you’ll come upon a gambling casino every few miles, in front of each Indian pueblo, with few cars in their parking lots. And in recent years, with non-Indians being allowed to get into gambling elsewhere, it’s not just intra-Indian competition that’s diluting the market.

Although legalized gambling had to come, it’s a problematic activity for society. There are the high-rollers at casinos in Las Vegas and Atlantic City and Connecticut. My impression of the bulk of bettors, however, is that they are desperate people who mostly play the one-armed bandits, dumping in their quarters, hoping for a bonanza.

For society to benefit by drawing money from legalized gambling- as it cannot from illegal gambling- is one thing. But to promote it, subsidize it and depend on it is another.

Then there’s the over-expansion, and the consequent cost to Native Americans including the Shinnecocks, who have had it tough economically for centuries and only recently achieved federal tribal recognition. They had been hoping for some payback, finally. Now the house may be rigging the game against them.

Capitol Consulants of Hawaii: Double Dipping Gambling Conflicts, Resume Padding Lies or Harboring Secret Partners?

When it comes to public disclosure of political campaign finance and lobbying activities, the State of Hawaii is akin to something you might find in a small unsophisticated backwoods town controlled by “Good Ol’ Boys.” There is no consistency. Record keeping and access to records are spotty. Electronic filing means emailing documents and databases are misunderstood. What is available for examination is either elementary or unnecessarily cumbersome and sheds little light. The most recent campaign finance disclosure available online date back to 2006 elections. Sunlight is something only found at a beach.  It’s clear that in Hawaii they don’t take public disclosure seriously. Nevertheless...

John Radcliffe is employed by Capitol Consultants of Hawaii (Capitol Consultants) a Honolulu-based lobbying firm.  The firm’s website identifies Radcliffe as Vice President and Lead Lobbyist.  Among others industries and special interests, he is closely identified as a lobbyist for labor.

By his resume, Radcliffe maintains he was first retained in 2001 to lobby for Detroit casino syndicators Michael Malik and Marian Ilitch, through their mouthpiece and politico Tom Shields; Lansing-based PR firm Marketing Resource Group.  It was reported extensively that the Detroiters launched an expensive 2-year unsuccessful push for the legalization of gambling in Hawaii in 2000 but public records for that period are not readily accessible so we were unable to confirm lobbying registrations or expenditures.

Although Radcliffe and his Detroiter clients have admittedly failed to file timely lobbying disclosures in the past --  at onetime even saying a lobbying report hadn’t been filed because it was “lost in a Michigan snow storm” -- TheVerifiableTruth.com can confirm Radcliffe was registered to represent the Detroiters in 2005, 2006 and 2007-2008.

TVT has been unable to find any records indicating Radcliffe registered to represent the Detroiters during 2009 when Gov. Linda Lingle, a Republican who opposes gambling in Hawaii, was still in office. 

But when the race for Hawaii’s next governor began in 2010, Radcliffe again registered to represent the Detroiters. 

And when Neil Abercrombie, a Democrat, was elected Governor, he asked Radcliffe to help him identify key staff members and make key appointments. Radcliffe again registered as lobbyist for the Detroiters in 2011.

George A. “Red” Morris is President and also a Lead Lobbyist at Capitol Consultants. He and Radcliffe are associates but Morris also maintains separately G. A. Morris, Inc.  As part of a resume that Morris shares via the G.A. Morris website, he claims  Marketing Resource Group (Detroiters) as a client from “2000-present.” 

TVT was able to confirm that Morris had registered as a lobbyist representing the Detroiters in January 2010 but according to the Hawaii State Ethics Committee Website, Morris was terminated as the Detroiters’ lobbyist a couple months later on April 30, 2010. However, TVT has found no other official lobbying disclosures to suggest Morris had ever reported lobbying for the Detroiters prior to 2010 despite the representations on Morris’ resume.

And given that Morris’ resume claims he was a lobbyist for the Detroiters from 2000-present, TVT was surprised to see that Morris’s resume also indicates Boyd Gaming as a Morris client from “1995-present.” Boyd is a publicly traded (NYSE: BYD) Las Vegas gambling conglomerate with casinos throughout the U.S. 

TVT has confirmed that Morris was registered as a lobbyist for Boyd Gaming in 2005 and from 2006-2008; and again following the 2010 termination as lobbyist for Marketing Resource Group.  As with Radcliffe, TVT found no records that he was registered to lobby for the either Detroiters or Boyd Gaming in 2009.  

Conflicts? Padded Resume Lies? Double Dipping? Secret Partners?
That Morris could have represented the Hawaii interests of Boyd Gaming at the same time he was representing the interests of Detroit casino syndicators is curious; although, clearly that’s what Morris’ resume suggests.  And why would Morris make misrepresentations on his resume?  Or did he?

Likewise, that Morris and Radcliffe, both principal lobbyists with the Capitol Consultants lobbying firm, could represent both the Detroiters and Boyd Gaming at the same time without a conflict is curious.

Typically, either circumstance would be recognized as presenting conflicts that clients wouldn’t tolerate; unless of course, Boyd Gaming and the Detroiters had no conflicts but rather, had shared interests in Hawaii.

Are Detroiters Again Fronting for Las Vegas?
If Morris wasn't misrepresenting circumstances on his resume, it is possible that while he only registered as a lobbyist for Boyd that he considered himself a lobbyist for the Detroiters if, in fact, the two entities had been coordinating efforts to legalize gambling in Hawaii and establish casinos on Oahu.

As a publicly traded company, Boyd might have to disclose its efforts to advance gambling in Hawaii and establish a casino.  If another group was fronting for Boyd's interests, Boyd might avoid the need for disclosures.  If the effort was unsuccessful, Boyd's shareholders wouldn't realize it as a failure by Boyd thereby minimizing any negative impacts to stock values.

In the mid 1990s, when the Detroiters were working to get gambling approved in the Motor City, they fronted for Las Vegas’ Circus Circus.  They secretly funded a last minute multi-million dollar advertising push as part of the campaign to win voter approval for gambling halls in Detroit and a partnership agreement that surfaced after the campaign made it clear the Detroiters had been “reimbursed,” by their Las Vegas partners, for the costs of the campaign.

There’s a stigma among voters and elected officials toward big Las Vegas gambling interests so they prefer to remain silent partners until approvals are in-hand.  The Detroiters are comfortable and able to front for their Las Vegas colleagues who have deep pockets and greater tolerance.  A couple of years ago, it was discovered that one of the Detroiters’ original MotorCity Casino partners, Herb Strather, was fronting a proposed Massachusetts casino, as they had in the mid 1990s, for South African gambling magnates Sol Kerzner and Len Wolman.

Michael Malik: The Latest Life & Times of a Detroit Casino Syndicator

Carrying on a 7-Year affair. Another illegitimate child. A $300k Las Vegas wedding. A 6-week marriage. Dirty divorce. Extravagant living. Drugs, alcohol & abhorrent sexual behavior. Bullying, intimidation & influence peddling.

No, that's not a teaser for a new reality-TV "Housewives" series but rather a glimpse into the private life and character of Detroit casino syndicator Michael J. Malik, Sr. He is a confidante and business partner of Detroit's Ilitch Family -- namely Mrs. Marian Ilitch -- founders of Little Caesars pizza, and owners of the Detroit Tigers (MLB), Detroit Red Wings (NHL) and several dozen other affiliates under the Illitch Holdings, Inc., umbrella.

On the heels of his 2003 divorce from Michele M. Malik and a reported affair with Heather Lufkins Robinson, Michael J. Malik, Sr., (age 50) began having a romantic relationship with stylist Brooke Anne Garwood (age 28).  Described by some as a kept woman, Malik provided Brooke with financial support for the next seven years  -- support that increased upon the November 2006  birth of their son Cameron Anthony Malik.

Seven years after beginning their affair, and three years after the birth of their son, Malik and Brooke Garwood were married in a Las Vegas, Nevada ceremony (January 21, 2010).  Malik says he spent more than $300,000 on wedding related expenses. 

Six weeks later (March 9, 2010) Malik had moved out of their new 5,000 square foot Birmingham home and filed for divorce in a Detroit area court.

From the time of Cameron’s birth until his parents were wed, Brooke and Cameron Malik resided at 1063 Bird Ave., Birmingham, Michigan. The 3 bedroom home was approximately 2,000 square foot and recorded a sale price of $350,000.

During this same period Mr. Malik resided at various locations. Several luxury residences in Grosse Pointe owned by Malik were forced into sale and Malik was the roommate/tenant of Detroit area restaurateur/grocer Victor Ventimiglia.  Malik defaulted on a $1 million personal line of credit with Fifth Third Bank; was delinquent on property taxes and had real estate in foreclosure.

For about a month after the Las Vegas wedding (February 10, 2010 to March 9, 2010) Michael, Brooke and Cameron all lived as a family at 350 Aspen Rd., Birmingham, Michigan.  They reportedly paid cash for the three bedroom / five bath home which was purchased February 1, 2010. Prior to the sale it had been listed at $2.3 million.

Then by March 9, 2010, Malik reports he had moved to The Townsend Hotel, 100 Townsend, Birmingham, Michigan.  Both parties had accused the other of outrageous amd abusive behavior, infidelities and indiscretions. A bitter divorce ensued.

Malik, a business syndicator who along with Marian Ilitch has bankrolled long-shot Indian gaming proposals in Michigan, California and New York with little success.  Over the last decade, he has advanced various failed gaming proposals with the Shinnecock Indian Nation of Long Island, New York. Their latest scheme centers on plans to develop an entertainment complex (casino, hotel, new train station) at the Belmont Park and Race Track on Long Island.  He's investing thousands to influence Governor Andrew Cuomo and other New York officials who will make the decisions.

During the first trimester of 2010, Michael Malik bought a penthouse residence at The Rushmore in New York City (80 Riverside Blvd., #PH4A, New York, NY 10069).  Prior to filing for divorce, Malik and Brooke made several trips to New York City looking for a residence to purchase and shopping for items to furnish the penthouse.  However, a shrewd Mr. Malik did not enter into a contract to purchase the penthouse until March 19, 2010, ten days after filing for divorce.  Penthouse 4A at The Rushmore sold to Mr. Malik on April 15, 2010, for nearly $5.4 million, reportedly paid in cash and closing only after he had separated from Brooke.

While the Maliks were married, they also kept a lavish vacation property at 4411 Pine Tree Drive on the Miami Beach Peninsula. That vulgar $7.9 million Mediterranean estate with a nearly 12,000 square foot mansion was available for $45,000 per month.  See More Estate Details:  Video Tour;  Slideshow;  For Sale Listing.

According to court documents and police reports, Miami Police were called to a scene at the Malik vacation home on March 13, 2010.  Cocaine and other drugs were reportedly in plain site (MBPD Crime Scene Report - Case No 10-24620). Various investigations suggest more than a dozen people had engaged in drug use and sexual debauchery during five days of continuous partying. Court documents indicate they “participated in the use and distribution of cocaine and other illegal substances and engaged in abhorrent sexual behaviors.” 


Malik asked that the Judge restrict public access to information revealed in divorce proceedings and the judge granted the protective order going forward.

In December 2010, the Court granted consent for a divorce.

Brooke Malik is now an associate with Cicchini Custom Clothier.

It's unclear where Mr. Malik is calling "home" and who, if anyone, he might be cavorting with at this time.

The Verifiable Truth
