Malik sentenced to community service for illegally taking elk

PINETOP-LAKESIDE - Michael Malik, a Michigan man who became the center of controversy after an elk hunt on Porter Mountain last July, has been sentenced to eight hours of community service.

Malik was found guilty of firing too close to an occupied structure on Aug. 4 after a July 31 bench trial that lasted over 10 hours. The Pinetop-Lakeside Justice Court said Malik must serve the community service within 60 days. Malik must also write letters of apology to homeowners of Mountain View Ranch on Porter Mountain, where the hunt took place.

The execution of the sentence will be suspended pending the court's consideration of Malik's motion for a new trial.

Ofc. Jim Hinkel, the law enforcement program manager for the Pinetop office of Arizona Game and Fish, said the sentence handed down was "disappointing" but the department will begin their own disciplinary process. He said Malik could face a revocation of his license and a minimum civil assessment of $8,000 for the elk he killed.

"What Mr. Malik is looking at is revocation of licenses to hunt, fish or trap for up to five years," he said.

Hinkel added those revocations would not just be limited to Arizona. Since Arizona is part of a interstate wildlife violator compact, Malik could face revocations in 32 states and seven Canadian provinces, including Utah, California and New Mexico.

"If you're revoked in any one of the participating states, you're revoked in the rest of them," he said.

Hinkel said he would have liked to see the justice court hand down a tougher sentence to show other potential offenders that wildlife violations would be taken seriously. However, he said it would not affect how Game and Fish carries out their action.

"We're moving forward," Hinkel said.

Mike Malik denied permit to develop Harsens Island Marina

The state Department of Environmental Quality has denied a marina permit for a 348-unit clustered housing development on the former Boys Club property on Harsens Island.

According to a letter from David Dortman, environmental quality analyst for the DEQ’s Land and Water Management Division, the proposed project “will have significant adverse impacts on the natural resources associated with the St. Clair River.

The developers, Grande Pointe Development and Lucky 7 Development LLC, had applied for the permit on May 1.

The proposed planned unit development has met with opposition from island residents. On Feb. 27, the Clay Township Planning Commission rejected a special land use request that would have allowed construction of the project.Grande Pointe and Lucky 7, which are owned and managed by former Clay Township resident Michael Malik, filed an appeal of the planning commission’s decision in St. Clair County Circuit Court. That appeal is still moving through the legal process. (Complete Story)

Charitable foundation affiliated with the family of Mike Ilitch uses $50,000 to purchase baseball tickets

According to its 2006 IRS Form 990, Ilitch Charities for Children (aka Ilitch Charities) spent $50,000 purchasing "baseball tickets" to distribute to "disadvantaged families."

Mike Ilitch, patriarch of Detroit's Ilitch family, owns the Detroit Tigers Major League Baseball (MLB) team. The family-owned Olympia Entertainment holds the mangament and licensing contracts for Comerica Park, the home field of the Detroit Tigers. Ilitch Holdings, Inc. is the parent company of these and other Ilitch family-owned enterprises.

Christopher Ilitch, CEO of Ilitch Holdings and a member of MotorCity Casino's management committee, is chairman of Ilitch Charities and his wife Kelle is a director. Christopher Ilitch's former executive assistant, David Agius, is president and treasurer of Ilitch Charities.

Ilitch charitable foundations used to promote struggling gambling hall


Detroit's powerful Ilitch family is using its various affiliated charitable foundations to promote and possibly even generate revenue for the struggling Detroit casino owned by the family's matriarch.

According to a press release marketing the two-day festivities, on August 24 & 25, Ilitch Charities along with the Detroit Tigers Foundation and the Detroit Red Wings Foundation, hosted a Detroit area golf tournament which was preceded by a "Summer Soiree" preview party at Detroit's MotorCity Casino.

The gambling hall is reportedly owned entirely by Mrs. Marian Ilitch. Family patriarch Patriarch Mike Ilitch owns the Detroit Tigers and along with Marian is co-owner of the Detroit Red Wings.

Christopher Ilitch, CEO of Ilitch Holdings and a member of MotorCity Casino's management committee, is the chairman of Ilitch Chairities and his wife Kelle is a director. David Agius, Christopher Ilitch's one-time executive assistant, is the President of Ilitch Charities. Patriarch Mike Ilitch owns the Detroit Tigers and along with Marian is co-owner of the Detroit Red Wings.
The Ilitch events were marketed as opportunities to play golf and mingle at MotorCity Casino with Hollywood celebrities as well as managers, players and coaches affiliated with the Ilitch owned Detroit Red Wings and Detroit Tigers.

The Ilitch family has been using its charitable foundations and other assets to promote and drive revenues to MotorCity Casino. Twice before the Detroit Red Wings Foundation and player from the NHL franchise have been used to promote poker tournaments at MotorCity Casino.

Major League Baseball (MLB) has strict prohibitions against gambling and casinos which apply to its players, managers, coaches and owners. The press release suggest those currently affiliated with the Tigers baseball team were partcipants at the MotorCity Casino party.

Even after spending more than $300,000 renovating and expanding MotorCity Casino, revenues at the Ilitch-owned gambling hall have been on the decline. Crain's Detroit reports that revenues at the Ilitch casino are down 1.5% over the previous 12 months and in July alone revenues took a 7.26% dive. In the last several years, Moody's and Standard & Poor's have downgraded the credit ratings for MotorCity Casino (aka CCM Merger, Inc.)

Attorneys try to block Malik's sentencing and keep him from possibly doing jail time


Michigan resident Michael Malik was found guilty earlier this month in Arizona on charges involving the illegal discharge of a firearm.

The Pinetop Justice Court was set to sentence Malik on August 15th but his attorneys have been working to block sentencing which could include up to four months in jail, two years of probation and a five year ban on hunting anywhere in the United States.

Reports out of Pinetop, Arizona, suggest Malik’s attorneys are frantically filing motions to block sentencing and keep him from possibly doing four months in jail. Malik and his hired guns are trying to find a way to appeal the court’s guilty finding and at least get Malik a new trial.

The Pinetop Justice Court is reported to have schedule another hearing in the matter on August 29th.

Local residents were furious with Malik’s disregard for Arizona’s gun and hunting laws and there’s been an outcry urging the court to make an example of millionaire Malik by giving him the maximum sentence. Other gun enthusiasts and hunters agree that Malik’s behavior was despicable.

Malik is a casino syndicator who is closely affiliated with Detroit's powerful Ilitch family.

Ilitch partner could serve four months in jail and up to two years probation


According to reports in The White Mountain Independent Detroit businessman Michael Malik was found guilty this month of illegal discharge of a firearm in Arizona.

The White Mountain Independent reports Arizona law make it illegal to discharge a firearm within a quarter-mile of an occupied residence while taking wildlife without permission.

Under Arizona Revised Statute 17-309 A 4, it is illegal to discharge a firearm within a quarter-mile of an occupied residence while taking wildlife without permission. It is considered an offense, punishable by up to $750 in fines plus 80 percent in surcharges, up to four months in jail and up to two years probation.

Malik is Mrs. Marian Ilitch's casino gaming partner. Ilitch owns Detroit's MotorCity Casino, Little Caesars Pizza and the Detroit Red Wings NHL franchise.

Olympia Entertainment partners with new entertainment promoter


According to a press release issued by TIX Corporation (Nasdaq:TIXC), a subsidiary known as Magic Arts & Entertainment announced its partnership and five-year agreement with Detroit-based Olympia Entertainment to present a Broadway series at the fabulous Fox Theatre in Detroit, Michigan.

This five-year agreement between the two companies also encompasses two other Olympia Entertainment-operated venues including: the Masonic Temple Theatre (4,000 seats) and The City Theatre (400 seats).

Magic Arts & Entertainment is headed by longtime-business partners Lee D. Marshall and Joe Marsh. In 2008, Magic Arts & Entertainment became part of Tix Corporation with Marshall and Marsh assuming the roles of Co-CEO of Tix Productions, a newly-formed subsidiary of Tix Corporation. The Magic office is run out of Cleveland, OH and Salt Lake City, UT.

Olympia Entertainment is one of the industry's most diverse sports and entertainment companies, owned by Detroit entrepreneurs Mike and Marian Ilitch. Prior to joining Jack Utsick Presents/Entertainment Group Fund/World Wide Entertainment (World Wide Entertainment - Michigan, LLC), Young was executive producer at the Ilitch-owned Olympia Entertainment (Detroit's Fox Theater) from 1998-2003.

According to Daily Variety, Greg Young, formerly an Indianapolis-based independent producer of road revivals, was hired and moved to Detroit in 1998 by Olympia Entertainment partly to develop new Broadway-style productions with an eye toward the national marketplace.

Young is currently a partner at Allterra Capital Partners, LLC and Variety reports Young is involved with a revival of Bob Fosse's "Dancin" which is set to stage at New York's Studio 54 in Spring 2009.

Jack Utsick/Entertainment Group Fund and other related promoters are the targets of a $300 million fraud case filed by the Securities and Exchange Commission (SEC).

Young, who is also reportedly the owner/operator of the Royal Oak Music Theater (ROMT) in the greater Detroit-area is also involved in the case. ROMT owed the World Wide Entertainment Group receivership $475,000.

Another Ilitch partner, Michael Malik, is also involved in the federal $300 million fraud case. Subsequent charges have been filed against Malik seeking his return of more than $2.1 million that a receivership alleges Malik received in a fraudulent transfer.

Michael J. Malik, Sr., the Ilitch family’s often controversial gaming partner and Gregory Young, formerly executive producer for the Ilitch-owned Olympia Entertainment (Detroit's Fox Theater), have been tied to a federal case charging Worldwide Entertainment, Inc. and Entertainment Group Fund, Inc. and their principal John P. (Jack) Utsick, and American Enterprises, Inc. and Entertainment Funds, Inc. and their principals Robert Yeager and Donna Yeager, in connection with a fraudulent offering that raised over $300 million from over 3,300 investors nationwide.

June 2008 charges filed in a Florida Federal District Court allege that Detroit casino syndicator Michael Malik was involved in a $2.1 million fraudulent transfer of funds – a so-called “Profit Payment” – involving the above parties. A receivership seeks to recover the $2.1 million plus related charges from Malik.

Greg Young, who was affiliated with Olympia Entertainment (Detroit’s Fox Theater) from 1998 – 2003, was affiliated with Utsick’s World Wide Entertainment Michigan, LLC. Young would reportedly become owner/operator of the Royal Oak Music Theatre in the greater Detroit-area and owed more than $400,000 to World Wide/Utsick. According to court documents and other reports, Young subsequently has partnered with AEG (Anschutz Entertainment Group); that agreement has reportedly provided Young with the $475,000 that will be returned to the World Wide, Utsick, et. al. receivership.

Malik and Vigliotti had formed MV Property Holdings LLC hoping to sell land to MGM Grand Detroit

Attorney William D. Serwer filed corporate documents in February 2002 establishing a Michigan limited liability company known as MV Property Holdings, LLC. Documents filed with the U.S. Attorney indicate that entity was a venture between Detroit casino syndicator Michael J. Malik, Sr. (aka Mike Malik, Michael Malik) and Ralph Vigliotti Realty, Inc. (R. Thomas Vigliotti).

Apparently Malik & Vigliotti had secured land in downtown Detroit that they were hoping to flip and sell to Las Vegas-based gaming giant MGM for future development of the MGM Grand Detroit.

MGM Grand Casino In Detroit Thrives While Others Falter

The city of Detroit is not any different than others in the United Stats. Whether or not their Red Wings won the Stanley Cup, they still are dealing with tough economic times.

Their casinos are following a trend throughout the country of revenue loss. While two of their casinos had revenue figures decrease from July of 2007, MGM Grand Detroit saved the day by posting a revenue increase.

MotorCity Casino had a decrease of 7.26 percent from last year in July. Their revenue of $39.6 million was down from $42.7 million last year.

Greektown Casino experienced a much more drastic drop in revenue. Their $25.4 million dropped off 13.2 percent from July of 2007. The two casinos are following the national norm for casinos.

MGM did not have such problems. They took in $50.5 million in revenue, an increase of a whopping 22.25 percent. That increase is unusual at a time where the economy is hurting almost every casino in the country.

Fuel prices have been cited at many of these casinos as the reason for revenue decreases. People have also been losing their jobs which is resulting in less gamblers having the money to frequent these casinos.

Ilitch partner found guilty on firearms charge in Arizona

According to a report by an Arizona newspaper, Detroit casino syndicator Michael J. Malik, Sr., has been found guilty in Arizona court on one count of unlawfully discharging a firearm and will be sentenced for the violation on August 15.

The charges against Malik stem from a 2007 elk hunt in which it was alleged that Malik had strayed onto private property and was shooting his firearm within close proximity of other people's homes.

Michael Malik is an associate and partner of Marian Ilitch and other members of the Detroit-based Ilitch family. Ilitch Holdings, Inc. is the parent company of such household name brands as Little Caesars Pizza, the Detroit Tigers baseball team, Detroit Red Wings NHL franchise and Detroit's MotorCity Casino.
Among other things, Mike Malik is the owner of the 1,000 acre Paradice Hunt Club in Davison, Michigan.

MotorCity Casino revenues drop again; down for 12-months despite new facilities

    ...Revenues show strain
    The economy's strain on Detroit's casinos is evident in the latest revenue numbers:

    • For MotorCity, year-to-date revenues are down 1.6 percent through July, and 7.26 percent last month alone compared to a year ago. The dips are particularly noteworthy because the casino last year didn't have its larger, renovated gaming hall and new hotel to attract gamblers.

    MotorCity officials said they don't comment on specific revenue numbers, but spokeswoman Jennifer Kulczycki said that the end of construction and renovation on the property later this year will have a positive impact on the casino's bottom line.

    "We're wrapping up construction right now," she said. "We're excited to show Detroit a completely brand new MotorCity Casino. We think it will leave a very good impression on our guests." (Complete Story)
